Vacation Leave Florida has no laws requiring employers to provide employees with vacation benefits, either paid or unpaid. When a holiday falls on Sunday, the following Monday is observed as a holiday. Full-time employees are entitled to one personal holiday each year. Personal holidays are credited to eligible employees on July 1, and must be taken by the employee by June 30 of each year. Section 110.117, F.S.

Florida is one of a third group of states, together with states like Texas and Alabama, that don't have any PTO laws about this subject. Florida has no laws at all that address payout of earned vacation time when an employee leaves. In these states, "use it or lose it" policies are not prohibited since there is no law on the subject.
