Under s.58 (2) (a), vacation pay must be paid to an employee "at least 7 days before the beginning of the employee’s vacation". This provision is to ensure that an employee has use of earned vacation pay on their holidays. In accordance with s.27 of the Act vacation pay should be identified on the wage statement.

When you hire a new employee at any time other that the very first day of the year, their vacation days must be prorated. The full number of vacation days that an employee is given is based off of a full calendar year in most instances, assuming that the company is working off an annual accrual policy (as most do).

If your employer uses a common anniversary date, then you can take your annual vacation after the first common anniversary date. As per workers law of BC, you are entitled to 3 weeks of paid vacation if you have been employed for 5 years at the same company. I'm going to be going on maternity leave for one year and wondered if when I return back to work, will I be entitled to 3 weeks paid vacation? Since by them I would have been an employee for 5 years.
